LA EFICACIA JURÍDICA DEL ACTA DE MEDIACIÓN Y LAS LIMITACIONES EN SU EJECUCIÓN POR INCUMPLIMIENTO RECÍPROCO
DE OBLIGACIONES
ABSTRACT: Under Ecuadorian law, mediation agreements have the force of res judicata
within the country’s judicial system. However, if there is a breach of reciprocal obligations,
their enforceability is suspended, a situation not expressly regulated by the General Organic
Code of Civil Procedure. The purpose of this study is to examine the legal limitations on the
enforcement of mediation agreements resulting from mutual non-compliance. This work is of
a dogmatic-analytical nature, as it systematizes specialized doctrine and regulations to
identify the procedural gap found. The periods under observation reveal a systemic
contradiction: while the Arbitration and Mediation Act (LAM) ensures that the agreement
becomes enforceable, the COGEP lacks a specific incidental mechanism to address the defense
of non-performance of contract (exceptio non adimpleti contractus) during the enforcement
phase, which arises from the final judgment. A comparison with Colombia and Spain shows
that there are more flexible procedural solutions than those adopted in Ecuador;
consequently, this lack of specific procedural means to enforce compliance with the
mediation agreement creates legal uncertainty and, as a result, leads to re-litigation, forcing
the parties to resort once again to ordinary courts a situation that runs counter to the
principles of expediency and reducing the caseload in alternative dispute resolution
mechanisms. All in all, we find that the enforceability of the mediation agreement ends up
being eroded in practice and affects the fundamental right to effective judicial protection.

INTRODUCCIÓN
El acta de mediación, dentro del marco del sistema procesal contemporáneo, se ha erigido en lo
que algunos pueden calificar como el equivalente jurisdiccional de obligatorio cumplimiento. De
conformidad a lo que prescribe el artículo 47 de la Ley de Arbitraje y Mediación y en
consonancia con el artículo 363 del COGEP, el acta de mediación constituye lo que
denominamos "fallo", con la consiguiente fuerza de cosa juzgada. Sin embargo, la
autosuficiencia jurídica de este título de ejecución no es absoluta, sino que depende de los
presupuestos de procedibilidad del derecho de obligaciones. Como muy acertadamente señala
Salazar (2024) (1), la fuerza ejecutiva de un título no descansa únicamente en su reconocimiento
formal, sino también en la "pureza y exigibilidad actual de la prestación que contiene".
El conflicto que da pie a la investigación surge en el momento en el que el acta de mediación
comporta obligaciones bilaterales o dicho de otra forma, prestaciones recíprocas e
interdependientes. La controversia surge en la fase de ejecución. La parte que ejecuta pretende
la tutela del órgano jurisdiccional para forzar a su contraparte a cumplir con su prestación,
aunque está en mora en el cumplimiento de su contrapartida también pactada en el mismo
título; esta circunstancia encuentra una solución con una paralización del procedimiento
